Nathani builders in legal tussle with tenant

Mazgaon court issues summon city’s top construction firm “Nathani Group” to be present before the court on 28th November. According to the complainant Mr Abdul Hameed Abdul Qayyum Shaikh a senior AMIM leader , ” I am fighting for my flat since 2011 , Builder cheated me and did not hand over the flats to me although I have all proof and documents that’s why I filed the complaint against the developer even today I have no issue with the developer if he considers my problem and is ready to give me my legal rights .”
The case has been filed by Mr. Abdul Hameed in 2011.case No 177/ SW/ 20 11 . under section 420, 467 ,468, 471. He has made the developer and tenant accuse in the case.The next hearing of the case is on 28th November.

On the other hand, Nathani Group says it is a pure dispute between two tenants, Mr. Hoshedar R Zaroliwala and Ardafarvash R Zaroliwala who are joint tenants of the old Room No 1A in ‘P’ Block of the Dalal Estate Apartments, Mumbai Central. The rent receipt of the said old room premises Is on the name of Mr.Firdosh Kodia temporarily on leave and Licence to occupy the said old premises for the temporary period. Mr.Firdosh Kodia had vacated the old Room in the year 2010 -11. The present complainant Shaikh Abdul Hamid tried to trespass The said old room by claiming right on the said old room through said License Mr.Firdosh Kodia the complainant Hamid Shaikh also filed a civil case in Bombay city civil court against the developer and the said tenant for stay of demolition of the old Room and the construction of the new building. interestingly there is no court order in the said civil case since 2011 against the builder till today. The entire case is between the said legal Tenants and Hamid Shaikh and the builder is nothing to do with this case.

Speaking with “Hello Mumbai ” over phone Nadeem supariwala one on the  Director of Nathani   Group said, ” we obey the court order whatever decision the court will pass we will obey it”.
