In a bizzare case a 15 year old girl (Pooja name changed as per SC guidelines) Patil, resident of Pokhran Road, Thane was sexually assaulted by one Akshay Sunil Chauhan under the pretext of marrying her. He lives in the nearby area of her parents in Gandhinagar.
A case has been registered in Chitalsar police station against five people including her alleged husband Akshay Chauhan under case No. 213/2022 Bhandvi 376 under Section 4 (2) 6,17 of POSCO Act 2012, Section 9 10, 11 of Prevention of Child Marriage Act 2006.
Story in brief of the case:
Akshay Chauhan had befriended Sarita and after sharing her mobile number had been in constant conversation with her.
Eventually, their mobile conversation grew by leaps and bounds steadily and he had sexual relations with her and lured her to get married. Akshay proposed for marriage.
Akshay Chauhan told her that they will have a child out of their relationship and that he will take care of the baby.
On the basis of the sex video he was repeatedly threatening her and blackmailing her to get married.
In a few months, the relationship between the two love birds bloomed like a flower and rape victim became five months pregnant. On the completion of nine months pregnancy, she gave birth to a beautiful child,
On 15 November 2021.
Victim’s parents and Akshay’s parents arranged the marriage with the consent of the family members.
But after few months, family feuds erupted.. Akshay started having doubt on her character and started abusing and beating her and threatened her of death. The brawl reached to a climax.
Victim reached her parents home on 15 September 2022. After that she approached Senior Social Worker and Journalist Dr. Binu Varghese.
Meanwhile,Dr. Binu Varghese intervened in the matter and approached Deputy Commissioner of Police and Senior Police Inspector Chitalsar Police Station and demanded arrest of the accused.
Subsequently the Chitalsar Police registered FIR against the concerned persons, husband Akshay Chauhan, father-in-law Sunil Chauhan, mother-in-law Chandravati Chauhan, Nanand Nikita Chauhan, Deer Suraj Chauhan and Reena under the Protection of Children from Sexual Offenses Act (POCSO) and Prevention of Child Marriage Act by Chitalsar Police.
Ultimately, Dr. Binu Varghese got justice to the under-aged married woman! The offence was registered under Prevention of Child Marriage Act including POCSO and rape by Chitalsar Police, Thane.
