The govt bid to formulate a law which will make triple talaq a criminal offence may be severely misused to harass Muslim men, Marriage and divorce are civil matters and any violation committed in them should be treated as civil offences only. Not only this it’s against the provisions of various constitutional articles, in which personal law of religion is protected, Yes, if there is violence, Protection of Women from Domestic Violence Act can be invoked, also when the honble SC invalidated talaq-e-biddat or instant triple talaq in August, it only made that form of talaq illegal. If uttering of that talaq is criminalized, victims of triple talaq will get further harassed as the doors of settlement will be closed. If the husband is sent to jail for uttering triple talaq, who will take care of the kids or give maintenance to the divorced woman, also how will it be proved that a man has uttered triple Talaq three times, no family member will give statement for sending his son or brothers to jail, for 3 years, What about giving justice to women in the families of Mohammed Akhlaq, Pehlu Khan and Junaid, and other victims by self appointed gav rakhshaks????
