Matka King’s  Son who is being now framed as The Matka King moves court challenging his arrest under MCOCA

Mumbai, July 31 Viral Savla has moved the Bombay High Court for booking him under the stringent Maharashtra Control of Organised Crime Act (MCOCA).

“I am innocent and MCOCA has been falsely implicated in the case by police,” Savla said in the petition.

The 30-year-old resident of Borivli suburb of Mumbai is a businessman.

The petition was filed before a division bench comprising Justice Ranjit More and Justice Bharti Dangre

The bench, however, refused to hear it on technical issue, and asked it to be placed before another bench.

In his petition, filed through advocate Randhir Kale, he told the court that he had been booked without any evidence against him. “There are no previous cases against me,” he said, adding that the arrest was illegal, unjust and unwarranted.

The petitioner was arrested under Maharashtra Gambling Act read with sections of the Bombay Prohibition Act and Bombay Police Act.

One of the arrested accused in the case Salim Mulla who was earlier arrested in multiple cases, and Mcoca is applied cause of the crime did by him and his wife in Kolhapur but according to Savla he does not have any links with him nor with the incident that took place in Kolhapur he was present in Mumbai on that particular day.

“The petitioner has been arrested on the basis of suspicious grounds and there was nothing on record that he has any nexus in the crime….nothing incriminating has been seized, recovered or discovered during the time of his custody,” it states.

The illegal arrest was affecting the fundamental rights of the petitioner, the petition states, adding that the Mcoca proceedings against him needs to be quashed.
