Ironically, South Mumbai’s oldest and reputed trust, Zakaria Masjid Trust gets embroiled in a fresh controversy for parting with property to Neena Realtors Pvt Ltd using Forged NOC.

A written complaint was recently filed by One kachi Memon Community Member Faraz Jamil Naaz and the copy of the complaint is in possession with Hello Mumbai News.
As per the complaint copy, Faraz Jamil Naaz demanded an high level inquiry and to initiate legal proceedings against the Trustees, Abdul Aziz Mandiwala,Mohammad Irshad Siddique Lakdawala,and Anjum Yaqub Mandiala.

In his complaint, the Complainant has claimed that the property bearing C.S. No.1398, Mandvi Division admeasuring 334. 45 sq meters tenanted trust property known as ‘Bazaarwala Building ” situated at Zakaria Masjid Street (Chawal Gali) This property was sold to Neena Realtors PVt Ltd without valid NOC from Maharadhtra Waqf Board by Zakaria Masjid Trust in 2012.

That the said deal is wholly illegal since as per Waqf Board Act, any Trust Propery cannot be sold to a private person or to any other firm.

In his complaint Faraz Jamil Naaz has further stated that the Maharashtra Waqf Board had issued a Showcause Notice dated 28th December 2020 in which it has been crystal clearly mentioned that the Board has not issued any kind of NOC to anyone pertaining to the Bazarwala Building Redevelopment issue. This aptly proves that a fake NOC may have been submitted by the Trustees to the Developer.

It’s, therefore, my request to the Mumbai Police to be kind enough to look into the matter and form a special team to investigate the matter and file an FIR against all culprits found guilty during the course of their investigation.

Hello Mumbai took the opportunity to catch up with the CEO of Maharashtra Waqf Board, Anis Shaikh pertaining to this issue. But despite repeated efforts he denied our phone call.

However, the newly elected Chairman of Maharashtra Waqf Board, Wajahat  Mirza apprised us over phone that, “yes I am very much aware of the entire matter regarding this Bazaarwala Building. We have already issued a Show Cause Notice to them and I am waiting for our Department inquiry report. Once I get it, will definitely take legal action against all and will file FIR also .

Whereas, Avinash Tukaram Shingte, ACP, Dongri Division, While speaking with Hello Mumbai News over phone, said, “when we receive the complaint, definitely, we will look in to the matter.
